This policy explains how we collect, use, disclose, and safeguard your information when you visit our website www.tdfence.com (the “Site”), request a quote, purchase products or services, or otherwise interact with us.
This policy addresses the requirements of the Nebraska Data Privacy Act (NDPA), the EU/UK General Data Protection Regulation (GDPR), and the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), since we are based in Nebraska, primarily serve Nebraska and surrounding areas, and may receive visitors from anywhere in the world. Sections below indicate which rights apply to which residents.

2.4 Categories Under CCPA/CPRA
For California residents, the categories above map to CCPA categories including: identifiers (name, email, IP address); customer records information (payment/billing details); commercial information (services requested, transaction history); internet or other electronic network activity (browsing/analytics data); geolocation data; and inferences drawn from the above. We do not knowingly collect sensitive personal information as defined by CPRA (e.g., precise geolocation beyond general area, government ID numbers, financial account login credentials) except payment card data necessary to complete a transaction, used solely for that purpose.

Future changes: If we begin selling or sharing personal information with third parties (including via advertising technologies that qualify as a “sale” or “sharing” under CCPA/CPRA or NDPA), we will update this Privacy Policy, provide any required notice, and implement a “Do Not Sell or Share My Personal Information” mechanism and honor opt-out preference signals, as required by applicable law, before doing so.

If you are located outside the United States, please be aware that information we collect will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. Where required (e.g., for EEA/UK personal data), we rely on appropriate safeguards such as Standard Contractual Clauses approved by the European Commission, or another valid transfer mechanism.

8.1 GDPR Rights (EU/UK/EEA Residents)
Subject to certain conditions and exceptions, you have the right to:

8.2 CCPA/CPRA Rights (California Residents)
You have the right to:

• Delete personal information we hold about you, subject to exceptions
• Correct inaccurate personal information
• Opt out of the sale or sharing of personal information (see Section 4)
• Limit the use/disclosure of sensitive personal information (not currently applicable, as we do not collect sensitive PI beyond payment data used solely to complete transactions)
• Non-discrimination for exercising your rights
We do not sell information for money, and, as noted above, are evaluating whether current ad-network integrations meet the CPRA definition of “share.”
8.3 Nebraska Data Privacy Act Rights (Nebraska Residents)
As of January 1, 2025, Nebraska residents have rights to confirm processing, access, correct, delete, obtain a portable copy of their data, and opt out of the sale of personal data, targeted advertising, and profiling in furtherance of decisions producing legal or similarly significant effects. We honor recognized universal opt-out signals (e.g., GPC) for these purposes.
8.4 How to Exercise Your Rights
To submit a request, email us at info@tdfence.com or complete a Data Deletion Request Form. We may need to verify your identity before processing a request. You may also designate an authorized agent to submit a request on your behalf, subject to verification.
• We will respond to verifiable requests within the timeframe required by applicable law (generally 45 days under CCPA/NDPA, extendable once by an additional 45 days with notice; one month under GDPR, extendable by two further months for complex requests).
• If we deny a Nebraska request, you may appeal; instructions will be provided in our response, and you may subsequently contact the Nebraska Attorney General’s office.
Kansas note: Kansas does not currently have a comprehensive consumer privacy statute, so Kansas residents do not have statutory rights equivalent to those above under state law, though the practices in this policy apply to all users regardless of location.
9. Data Security
We implement reasonable technical and organizational measures designed to protect personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. Children’s Privacy
Our Site and services are not directed to, and we do not knowingly collect personal information from, children under 13 (or under 16, where required by applicable law, including for consent to processing under GDPR in certain EU member states). If we learn we have inadvertently collected information from a child, we will take steps to delete it. Parents or guardians who believe we may have collected information from a child should contact us at the address in Section 1.
